The Criminal Court of Appeal yesterday referred a case back to the Magistrates' Court after a man who had pleaded guilty argued he was not given enough time to reconsider his admission.

Sasa Pavlovic had been found guilty of theft of Lm1,800 committed to the detriment of Marquita Diacono on the night of July 31.

The Criminal Court of Appeal noted that the accused had been imprisoned for 18 months and ordered to pay all the damages suffered by the victim.

The court, presided over by Mr Justice Joseph Galea Debono, noted that in the proceedings of the case there was no reference that the accused was given time to reconsider his plea and that he was warned about the legal consequences of such action.

The records of the case only indicated that, having heard the accused plead guilty, the court declared him guilty of the charges brought against him.

The judge sent the records of the case back to the Magistrates' Court to re-hear the case.
