Tour de France winner Floyd Landis will ask the United States Anti-Doping Agency (USADA) to drop the case against him, his representative said.
"We will be providing more details about the grounds of the motion for dismissal," Michael Henson told Reuters.
Samples taken from Landis during the Tour in July showed excessive amounts of the male sex hormone testosterone and the American faces being stripped of victory and incurring a two-year ban. The US Cycling Federation referred the case to the USADA, who set up a review panel which has to make a recommendation on whether or not there is a case.
If the USADA does charge the rider, he will have the opportunity to contest the decision and the recommended sanction before a US panel of judges.
Landis's lawyers could then take the matter to the Court of Arbitration for Sport (CAS).
Landis tested positive for testosterone after an astounding comeback in the final mountain stage of the Tour de France, a day after a poor performance all but knocked him out of contention.
