Police are taking criminal action against a 48-year-old man for allegedly causing the death of a 66-year-old woman when he ran her over soon after she walked out of a wedding reception over two years ago.
Marius Micallef, of St Paul's Bay, has been served with a summons to appear in court for involuntarily causing the death of 66-year-old Josephine Gauci on September 19, 2004, in Qormi at about 1 a.m.
Action against Mr Micallef was taken a few weeks after Mrs Gauci's husband, Gerald Gauci, filed a challenge against the Police Commissioner demanding that criminal action be taken against the man who ran over his wife.
In his testimony during the challenge proceedings last month, Mr Gauci explained that his wife had been run over by a car in Qormi as they were leaving a wedding reception. She had suffered serious injures and died in hospital a month later.
Eyewitnesses, he said, had noted the registration number of the vehicle and the identity of the driver was eventually traced.
However, despite several efforts the police did not take any action against the man. Challenge proceedings will now be dropped once the summons has been issued against Mr Micallef.
Police Inspector Maria Stella Cutajar is prosecuting.
Lawyer Anglu Farrugia is representing the Gaucis.
