The First Hall of the Civil Court yesterday upheld a writ of summons filed by the Malta Sports Council against Rea Ceramics Co. Ltd and ordered the company to pay almost Lm5,000 in damages.
Mr Justice Mallia heard that the company had been awarded a tender to replace the floor of the national pool at Gzira.
The company had contracted to carry out this work against payment of Lm18,846.25. However, the court found that the company had not been technically competent to do the job. The court heard that the base of the new flooring did not attach properly to the floor of the pool because the pool had not been cleaned properly. Nor had the company followed the application specifications for the pool cladding.
In conclusion, the court found that the council had suffered damages including loss of water and loss of use of the pool. The company was ordered to pay the council Lm4,829.87 in damages.
