A company yesterday filed an application in the First Hall of the Civil Court calling for the revocation of letters of acceptance of tenders issued by the Department of Contracts.
Gafa Saveways Ltd filed its application against the Contracts Department, the Health Department and Jescer Cleaning Services Ltd.
The company claimed it had submitted a tender for works to be carried out at Qormi, Rabat, Paola, Cospicua, Mosta and Birkirkara health centres following a call for applications by the Health Department. The tenders had been awarded to Jescer, even though Gafa's offer was the best.
According to the company, the tender submitted by Jescer did not comply with the requirements of the Social Security Act.
In conclusion, the company called upon the court to declare that the tender process was flawed as it had not been awarded to the best bidder and, thus, it should annul the award.
The court was also asked to order the authorities to issue a new call for tenders and to make good the damages sustained.
Lawyers Edward Gatt and Veronique Dalli signed the application.
