Injured passenger wins Lm28,000 damages

Mr Justice Tonio Mallia, sitting in the First Hall of the Civil Court, yesterday awarded damages amounting to over Lm28,000 to a man injured in a traffic accident in 1993.

The judgment was delivered in the case filed by Ivan Grech against Jason Debono.

Ivan Grech claimed he had been injured in a traffic accident in October 1993 while he was a passenger in a car being driven in Marsalforn.

He accused Jason Debono of being solely responsible for the damages and asked the court to order Mr Debono to make good the damages he had sustained as a result of a permanent injury.

The court heard that when the accident occurred George Curmi, Mr Grech and Carmel Cini were in a car being driven by Mr Curmi. Mr Grech was sitting in the front and Mr Cini was on the back seat. The three men were on their way from Victoria to Marsalforn.

According to Mr Grech, the car was involved in a collision with the car Mr Debono was driving on the wrong side of the road.

The court concluded that Mr Debono was solely responsible for the collision and for the damages sustained as he was driving on the wrong side of the road and had crashed head on with Mr Curmi's car.

The court heard that Mr Grech had sustained a 30 per cent permanent disability and ordered Mr Debono to pay him damages to the tune of Lm28,255.80.
