In this case the consumer, Mr P.L.L. Gussenhoven wrote a letter to Datax about two modems he bought from Datax:
"The first one was bought on December 7, 2004, for Lm7.70 and the second one was bought on January 12, 2005, for Lm10.45, the latter was due to an extra pollution tax.
The first modem 'died' on October 14, 2005, and the second 'died' on November 12, 2005, both dates are well in the limit of one year.
On January 10, 2006, I visited your shop in the morning to have the second modem replaced for another one due to the guarantee label of three years on the box... (P.L.L. Gussenhoven)

In this context may I respectfully bring to your attention that this very same modem (now 'disposed' of by your neighbour) worked without problem from December 7, 2004, till at least October 2005.
Regarding the guarantee there is no issue... in accordance with the law i.e. two years from date of sale...
Both of us - your good self and the undersigned - have gone over the present issue with the (now) sole existing modem. You have confirmed that this (second) modem again worked without problems from January 2005 to November 12, 2005...
Be that as it may, I reiterate that we will gladly provide a replacement/refund under warranty if this is the case ...
At the same time, please rest assured that I will concurrently have under test a new modem in your presence and which modem will be given to you free of charge as a replacement... (Stephen Saliba, managing director, Datax)
Here follows an excerpt from Mr P.L.L. Gussenhoven's final message which positively concluded this issue:
Modem 2 is still working because I made a mistake by bringing the wrong defect modem from another manufacturer with a severe burned short circuit. It was my mistake. Datax had nothing to do with the faulty modem...
The matter has been resolved. No further action required. My apologies for the mistake I made. (P.L.L. Gussenhoven)
