Lately we have been featuring cases in which the traders involved, despite having been given more than a fair opportunity to give us their side of the case, choose to bury their heads in the sand and ignore all communications from us.

I appeal to such traders to respond by giving us their side of the case. After all, apart from the fact that it is in their interest to do so, it is also their right. Indeed a right we always honour. Here follows a case involving another trader, who does not want to send us his side of the case:

I bought a new Nokia Titanium 8850 from Phonitel Malta which, unfortunately, only lasted two months! I am a Nokia fan and I think they are the best mobiles on the market, especially for their durability.

I was eating in a restaurant and I just dropped this mobile from the table to the floor, whereupon it switched off and would not restart. I took it back to Phonitel, who told me that the motherboard had a short circuit and could not be repaired!

Mobile phones are not to be dropped but I think that everyone has dropped his/her mobile more than once without doing any damage to it. It was just a simple drop from a table!

Phonitel Malta told me that they cannot replace the mobile because it was my fault that the mobile has this damage. I really can't explain to myself how come a mobile of this strength like the Nokia 8850 Titanium with a body made of metal cannot work again after a simple drop!

I am almost sure that this was a factory fault but Phonitel Malta don't want to listen to my complaint and just dropped the line when I phoned. Please be aware from where you buy mobiles and read carefully the warranty agreement on the paper before committing yourselves. (Kevin Zammit)

On January 5, we sent Phonitel Malta a copy of the above letter and asked for their comments, to no avail. On February 2, we sent them another copy and a reminder, still to no avail. Subsequently, we sent them three more copies of the above letter with requests for their side of the case on April 6, May 11, and May 5, all to no avail.

If Phonitel Malta wish to give us their side of the case, they are still welcome to do so.
