A woman has filed a counter-protest in the First Hall of the Civil Court in which she declared that allegations made against her in a previous protest by Jean and Daniela Galea Souchet were unfounded in fact and at law.

Carmela Cherubina Mercieca claimed that the Galea Souchets had alleged that she was causing them damage by telling estate agents that their (the Galea Souchets') property was not built according to law. As a result, Cherubina Mercieca was putting off prospective purchasers of the property.

The contents of the protest were unfounded, said Cherubina Mercieca, for if one verified the facts with the Malta Environment and Planning Authority, one would realise that no definitive permit had as yet been issued by the authority in respect of the Galea Souchets' property. Two appeals were pending on the permit for the property.

Furthermore, Cherubina Mercieca added that she had instituted a court case against the Galea Souchets in which she claimed that she had sustained damages as the Galea Souchets had failed to properly plaster the wall dividing the two properties at Madliena.

In yesterday's counter-protest Cherubina Mercieca added that the compliance certificate in respect of the Galea Souchets' property had been issued on the basis of a false declaration.

She concluded by categorically denying the allegations made against her by the Galea Souchets and held respondents liable in damages.

Dr Anna Mallia signed the counter-protest.
