Mr Justice Lino Farrugia Sacco presiding over the Tribunal for the Investigation of Injustices yesterday dismissed an application filed by Carmen Camilleri.
The applicant filed her claim against the Health Minister and the Health Department.
The minister responsible for labour, the Employment Department and the Employment and Training Corporation were later called into the suit.
Camilleri claimed she had sustained an injustice when she worked as a health assistant. She had chosen to work at St Vincent De Paule hospital but was told she had to report for work at Mount Carmel Hospital.
She had been allowed to work at the hospital of her choice, but, after only two days, she was told to report for work at Mount Carmel Hospital. Camilleri claimed she had sustained an injustice and requested the tribunal to grant her a remedy.
However, the tribunal dismissed Camilleri's application after finding that she ought to have filed her application against the Chief Government Medical Officer.
It resulted from the evidence produced that Camilleri had not in fact been employed by the Health Department. This was confirmed both by representatives of the department and by ETC officials.
Camilleri had not exhibited her letter of appointment or copies of any pay cheques she had received.
The fact that Camilleri had exhibited a photograph of a uniform was not sufficient to prove she had been employed with the Health Department.
In any event, even had Camilleri been employed by the Health Department, any application filed by her to complain of an alleged injustice ought to have been filed against the Chief Government Medical Officer.
The tribunal proceeded to dismiss Camilleri's application with costs against her.
