A man who was originally fined Lm400 for seriously injuring a man had his fine reduced to Lm116 after an appeal court ruled that he had acted in self-defence but that his reaction was excessive.
Karmenu Cutajar had been found guilty of seriously injuring Vincent Barun by hitting him with a spirit-level following an argument at work on March 27, 2002.
But after evaluating the evidence, Chief Justice Vincent DeGaetano ruled that Cutajar had reacted in self-defence after Barun waved his arms at him during the argument. However, Cutajar had over-reacted.
