The Civil Court has dismissed a writ of summons filed by the Floriana football club to request the retrial of a case decided against it in 2001.

The court heard that Anthony and Moira Grech Sant had filed a writ of summons in the Civil Court in 2000, requesting the court to condemn the club to refund Lm91,196 they had loaned the club over a period of time.

According to the Grech Sants, the club had failed to refund the money even though it had not been donated to the club but loaned to it.

On March 29, 2001 the Civil Court had upheld the Grech Sants' writ as it resulted that the club had been duly served with the writ of summons but had failed to contest the claim.

The club was ordered to refund the money with legal interest.

But the club then filed a writ of summons requesting the Civil Court to order the retrial of the suit on the grounds that the club had not been duly served with the writ according to law.

Mr Justice Joseph R Micallef yesterday dismissed the club's writ with costs.
