Fined for appealing frivolously

An appeal court yesterday fined a man Lm100 for filing a frivolous appeal.

Joseph Bone appealed a judgment jailing him for 15 days for failing to pay his wife alimony on and before March 8 in breach of a Civil Court ruling .

Bone claimed the Magistrates' Court failure to give reasons for its judgment constituted a breach of human rights.

But Chief Justice Vincent DeGaetano noted that the Magistrates' Court had given more reasons than it was required to give.

He confirmed the 15-day jail term and added a Lm100 fine for a frivolous and vexatious appeal.
