A man has been jailed for three months and fined Lm400 for heroin possession but was acquitted of trafficking on conflicting evidence.

Magistrate Noel Cuschieri jailed Lawrence Attard, 38, after hearing how police saw him arguing with Alex Templeman in Msida on August 15, 1999, and intervened.

Attard suddenly took out a plastic capsule with eight sachets of heroin and claimed he had just bought it off Templeman.

Attard claimed he originally bought 10 heroin sachets for Lm80 but Templeman asked him to return two and he would replace them later.

Templeman left but returned a second time to ask for a third sachet and an argument ensued.

But Templeman claimed it was Attard who tried to sell him drugs and the argument started because he refused.

Police Inspector Sandro Gatt prosecuted.
